How to read a constitutional judgment

01

Start with the question

Identify the constitutional issue the Court was asked to decide. A judgment does not answer every question connected with a dispute.

02

Separate holding from discussion

The binding legal rule is not the same as every observation in an opinion. Bench strength and later decisions also matter.

03

Read every opinion

A larger bench may contain several concurring and dissenting opinions. Compare their reasoning instead of relying only on a headline.

04

Check later treatment

Verify whether a later bench followed, distinguished, limited or overruled the proposition you are studying.
